AI Hiring Bias Is Now a Legal Risk: What the Mobley v. Workday Ruling Means for Enterprise HR

For two years, AI hiring compliance was a conversation about best practices and theoretical risk. In March 2026, a US federal court advanced Mobley v. Workday as a class action under the Age Discrimination in Employment Act.

The theoretical became actual.

The Cases That Matter

Mobley v. Workday (ADEA, March 2026): The court’s decision to advance this as a class action is significant for one reason: it signals that AI vendors — not just the employers who deploy their tools — can be held liable as employment “agents.” If this framing holds, every enterprise using a third-party AI screening tool has a new question to answer: what liability am I carrying on their behalf?

The UW Study: Researchers at the University of Washington found that when recruiters used AI tools with baked-in bias, they mirrored the inequitable AI choices 90% of the time. The human wasn’t correcting the AI. The human was amplifying it.

EU AI Act — August 2, 2026: The EU has formally classified AI tools used in hiring decisions as “high-risk” systems under the AI Act. Enforcement begins August 2, 2026. For any enterprise with EU operations or EU-based candidates, this is not optional compliance.

What Enterprise HR Is Actually Doing

SHRM’s 2026 State of AI in HR report found that 39% of organisations have formally adopted AI in HR — but only a fraction have completed compliance reviews of their tools. The gap between deployment and governance is wide.

This creates a specific, measurable risk: tools purchased in 2024 for speed or cost reasons, deployed without bias audits, are now running in a legal environment that didn’t exist when the procurement decision was made.

The Structural Argument for Voice AI

Here’s what most compliance conversations miss: unstructured human phone screens carry more legal exposure than well-designed AI screening, not less.

When a recruiter makes discretionary phone screen decisions without a structured evaluation framework:

  • There is no audit trail
  • Criteria vary by interviewer
  • Decisions may be influenced by accent, tone, perceived demographics
  • None of this is documentable or defensible in court

When a voice AI conducts the same screen with a standardised question set, consistent evaluation rubric, and documented scoring logic:

  • Every interaction is recorded and transcribable
  • Identical criteria apply to every candidate
  • The evaluation framework was defined before the screen ran
  • Disparate impact can be tested and documented

The compliance risk isn’t “AI in hiring.” It’s unaudited, unexplainable AI in hiring. A structured voice AI with a documented evaluation framework is defensible. A black-box scoring system or an undocumented human process is not.

India’s Regulatory Context

While the Mobley case and EU AI Act are US and European developments, India is not static. The Digital Personal Data Protection (DPDP) Act and MeitY’s emerging AI Governance Guidelines are establishing a regulatory direction.

For Indian enterprises, the practical implication is to build governance practices now — before enforcement arrives — rather than retroactively. The enterprises that operate in US or EU markets, or that hire candidates who might eventually relocate there, have more immediate exposure.

A Compliance Checklist for AI Hiring Tools

Before your next campaign runs, answer these five questions about every AI tool in your hiring funnel:

  1. Auditability: Can the tool explain why a specific candidate was rejected, in terms that reference job-relevant criteria?
  2. Bias testing: Has the tool been tested for disparate impact across gender, age, and ethnicity? Is the test documentation available?
  3. Structured criteria: Were evaluation criteria documented before the screen ran? Post-hoc justification is legally weak.
  4. Human oversight: Does your process include a documented human review step before final rejection? This is required under California’s AI hiring law.
  5. Vendor liability: Does your contract with the AI vendor address their responsibilities under ADEA, FCRA, or equivalent frameworks?

If you can’t answer yes to all five, you are carrying legal risk that your procurement process did not account for.

What to Do Now

The enterprises that will be fine in the Mobley era are the ones running structured, auditable, consistently-applied screening processes — whether human or AI. The ones at risk are running opaque processes and assuming that because they’re not Workday, the lawsuits won’t reach them.
